Known troublemaker gets 3 days in jail over assault of store customer

The Superior Court has imposed a three-day jail term on a man who while intoxicated assaulted two men for no apparent reason at a store in Garapan last August.

Associate Judge Ramona V. Manglona sentenced Felipe Lieto Kalen to one year in prison, all suspended except for three days, for one count of assault and battery.

Manglona gave the 50-year-old Kalen credit for the three days he already served in jail.

Kalen will be placed on one year of supervised probation. He is required to pay a $25 court assessment fee and $100 in probation fee.

Manglona prohibited the defendant from either possessing or consuming alcoholic beverages during the term of his probation.

Manglona ordered Kalen to return to court for a review hearing on Feb. 17, 2010.

“Defendant's failure to appear will result in the issuance of a bench warrant,” the judge stressed.

On August 5, 2009, police arrested Kalen for assault and battery, and disturbing the peace, for assaulting two men at QQ Store in Garapan.

Kalen signed a plea agreement. He pleaded guilty to one count of assault and battery.

Police said that the defendant attacked two men in the early morning of Aug. 2, 2009.

One victim suffered minor abrasions on the right elbow and knee when Kalen pushed him.

The intoxicated Kalen approached a customer outside the store and challenged him to a fight. The customer ignored him and walked away.

Kalen approached another man and pushed him on the chest. The person fell to the ground.

When another male customer went inside the store, Kalen approached and pushed his head.
