Bicyclist sues driver of car that struck him

A man has filed a lawsuit against the driver of a car that allegedly struck him while he was driving a bicycle on Beach Road in Chalan Kanoa.

Patit Pabang Mondal, a Bangladeshi, sued Masatoshi Otsuka for reckless, careless, and negligent driving.

Mondal, through counsel Victorino DLG. Torres, asked the Superior Court to hold Otsuka liable for damages over his injuries and to his bicycle.

Torres stated in the complaint that, on Sept. 25, 2012, Mondal was riding his folding mountain bike south toward Payless Super Market on Beach Road.

Torres said a silver 2003 Toyota Camry driven by Otsuka suddenly exited the northern entrance/exit road from Payless and entered the ongoing traffic.

Otsuka's car directly struck Mondal, who was crossing the road.

Torres said Mondal was transported to the hospital where he was treated.

Torres said in the event that the defendant contends that he hit Mondal immediately after he entered the thorough traffic and assumed his appropriate lane, Otsuka is still negligent in that, among other things, he failed to keep a proper lookout and failed to obey traffic laws.
