Man pleads guilty to disturbing the peace

A 65-year-old man accused of sexually assaulting his neighbor in Afetnas has pleaded guilty to disturbing the peace as part of a plea deal and was sentenced to 25 days in prison.

Superior Court Associate Judge David A. Wiseman accepted Emilio Dela Pena's plea last week and sentenced him to six months in prison, all suspended except 25 days. He was given credit for 11 days for time served.

The defendant was required to report to the Department of Corrections last Monday, Feb. 4. He is expected to be released on Feb. 18.

After his release, Dela Pena will be placed on probation for six month. He was ordered to pay a $200 fine, $25 court assessment fee, and $60 in probation fee.

During his probation, the defendant is prohibited from having direct or indirect contact with the victim.

A police officer was dispatched to Afetnas in the morning of July 21, 2012, where an attempted rape allegedly occurred.

When a police officer arrived at the scene, the victim was hysterical and told him that her neighbor, Dela Pena, tried to rape her.

The victim told police that Dela Pena went to her house and asked for coffee. Later, the defendant allegedly grabbed her breasts and tried to remove her shirt and attempted to kiss her.

When the victim shouted to call the police, Dela Pena ran to his house and left on a car.

Dela Pena told police that he had no intention of touching the victim's breasts as he was only trying to give her his cup.
