U.S. District Court Senior Judge Alex R. Munson set yesterday a settlement conference for Nov. 7, 2013, in Saipan Air Inc.’s $50-million racketeering lawsuit against three executives of Swift Air LLC. Munson directed representatives and lawyers for each party to attend the conference in the U.S. District Court for the NMI.
The judge said the parties are invited, but not required, to submit a confidential statement.
He said the statements shall not become part of the files of the case and shall not be used in preparing and conducting the settlement conference.
“Copies of the statement shall not be provided to the other parties in the case and statements will be destroyed at the conclusion of the settlement conference,” Munson said.
He said the statements should include an outline of the facts of the case, major issues in dispute, remedy sought, and any other information useful to the judge in analyzing the factual and legal issues in the case.
Munson said settlement statements should be emailed to him by Oct. 25, 2013.
The jury trial will be on Nov. 13, 2013.
Saipan Air is suing Donald A. Stukes, Jeffrey Conry, Hank Robert, and 10 unnamed co-defendants for allegedly conspiring to fraudulently obtain money and other property from Saipan Air Inc.
Saipan Air is suing the defendants for fraud, violations of the Racketeer Influenced and Corrupt Organizations Act, and unjust enrichment.
