Police arrested a man on Tuesday night in Garapan on charges that while intoxicated last July he threw several rocks toward the parking lot of an apartment in Garapan where a birthday party occurred and there were some children.
Marco W. Selepeo Fitial, 33, was arrested for assault with a dangerous weapon, criminal mischief, and disturbing the peace.
At yesterday’s hearing, Superior Court Associate Judge David A. Wiseman increased Fitial bail from $10,000 to $25,000 cash bail after learning that he has a bench warrant and criminal history.
Preliminary hearing will be on Sept. 24 at 1:30pm.
Detective Isapen Bokuku stated in her report that preliminary investigation showed that police officers responded to Casa De Felipe apartment in Garapan after a caller reported to the Department of Public Safety on July 25 at 11:14pm about a man throwing rocks.
Bokuku said according to witnesses, Fitial, who appeared drunk, walked to the parking lot where a birthday party was held for a boy and his family and friends.
Since Fitial was just staring at the party, he was invited to eat. After eating, he threw his trash on the table, scattering the food. Fitial left the place after he was told to leave.
After a few minutes, Fitial stood by the entrance of the apartment and started throwing about five rocks at the party site. People attending the party ran for safety.
Fitial was later arrested. He was subsequently released as police then conducted a follow-up investigation.
