Probable cause was found yesterday to warrant the filing of charges against a man who allegedly threw rocks at a birthday party in Garapan where there were some children.
At a preliminary hearing, Superior Court judge pro tem Timothy H.Bellas found probable cause to charge Marco W. Selepeo Fitial with assault with a dangerous weapon, criminal mischief, disturbing the peace, and criminal trespass.
The 33-year-old Fitial is being held on a $25,000 cash bail.
Assistant attorney general Margo Brown appeared for the government at the hearing. Assistant public defender Michael Sato represented the suspect.
According to the information filed by chief prosecutor Shelli Neal, on July 25, 2013, Fitial assaulted three men with rocks, causing damage to a 2007 Toyota Yaris. The suspect allegedly refused to leave the place despite being told to do so.
Preliminary police investigation showed that Fitial, who appeared drunk, walked to the parking lot of Casa De Felipe apartment where a birthday party was being held for a boy and his family and friends.
Since Fitial was just staring at the party, he was invited to eat. After eating, he threw his trash on the table, scattering the food. He left the place after being told to leave.
After a few minutes, the suspect showed up again at the apartment and allegedly threw about five rocks at the party site. People attending the party ran for safety.
