A motorist has filed a lawsuit in federal court against the driver of a vehicle who was allegedly lighting a cigarette that resulted in a vehicular collision.
Joseph DLR. Gonzales, through counsel David G. Banes, sued Robert Marc Weinberg, for negligence. Weinberg is believed currently residing in Florida.
Gonzales asked the U.S. District Court for the NMI to order the defendant to pay him damages and court costs.
Banes stated in the complaint that on May 30, 2007, Gonzales was driving a 1996 Toyota Corolla along Isa Drive by Ahgaga Drive in Papago, Saipan, heading south.
Banes said a southbound 2000 Hyundai Santa Fe being driven by Weinberg suddenly appeared on top of the hill and veered toward Gonzales' lane, hitting the plaintiff's car.
The lawyer said that, based on their information, the defendant lost control of his car because he was lighting a cigarette.
He said the force of the impact caused the car of Gonzales to spin around.
An ambulance was called and Gonzales was brought to the Commonwealth Health Center for treatment of injuries.
