A woman has filed a lawsuit in federal court on behalf of a student who was injured in a car accident near Hopwood Junior High School.<\/p>\n
Joanne T. Deleon Guerrero, guardian of a 16-year-old Mt. Carmel High School student, sued Sheng Wang Dong, the driver of a truck that hit the boy\u2019s vehicle.<\/p>\n
Deleon Guerrero, through counsel David G. Banes, asked the U.S. District Court for the NMI to order Dong to pay damages, attorney\u2019s fees, and court costs.<\/p>\n
Banes alleged in the complaint that \u201cas a further and proximate result of the recklessness and negligence of the defendant, [the student] suffered and continues to suffer physical and mental pain and anguish, all to plaintiff\u2019s damage.\u201d<\/p>\n
Banes stated that Dong was the authorized driver of a 1997 Kia Bonggo Flatbed truck when the accident happened on Sept. 14, 2006.<\/p>\n
The lawyer said the defendant \u201cwith deliberate disregard and reckless indifference to the safety of others, recklessly, grossly, negligently and carelessly operated the truck in violation of the NMI\u2019s vehicular laws.\u2019<\/p>\n
He said Dong\u2019s truck collided with a vehicle owned by Deleon Guerrero, causing the student\u2019s injuries and property damage.<\/p>\n
Banes said police interviewed a witness, who stated that the defendant \u201cwas going very fast.\u201d<\/p>\n
He said police concluded that Dong was at fault for failure to drive at a prudent speed.<\/p>\n
\u201cAt the time of the filing of this complaint, [the student] has not fully recovered from his injuries and his damages continue to accrue,\u201d Banes pointed out.<\/p>\n
According to the police report, the student was driving a Ford Explorer with a friend heading south to Chalan Piao in the afternoon of Sept. 14.<\/p>\n
When they passed the Chalan Piao traffic light near Hopwood, the student slowed down to make a left turn into the inner lane.<\/p>\n
The truck behind, being driven by Dong, collided with the student\u2019s vehicle, the report said.<\/p>\n
