A pedestrian who was injured after he was hit by a vehicle while walking along Beach Road in San Jose has sued the motorist.<\/p>\n
Estanislao L. Norita sued Robert Bernard C. Travilla for negligence.<\/p>\n
Norita, through counsel David G. Banes, asked the Superior Court to order Travilla to pay him damages, attorney\u2019s fees, and court costs. He asked for a jury trial.<\/p>\n
Banes stated in the complaint that Travilla was the registered owner and operator of a 1997 Honda Accord when the accident happened.<\/p>\n
Banes said that on Sept. 23, 2006 Norita was walking along Beach Road in San Jose when, without warning, Travilla\u2019s vehicle struck him.<\/p>\n
The lawyer said that an ambulance was called and Norita, who suffered serious injuries, was transported to the Commonwealth Health Center.<\/p>\n
\u201cTravilla, with reckless indifference to the safety of others, recklessly, grossly, negligently and carelessly operated his vehicle and failed to keep a proper lookout for other users of the road, including Norita, all in violation of the Commonwealth\u2019s vehicular laws, so that his vehicle hit Norita, causing his injuries, \u201c Banes alleged.<\/p>\n
