Manglona sentenced Vicente Taitano Fitial to five years in prison, all suspended except for the first three days.<\/p>\n<p>Following a plea agreement, Manglona gave the 59-year-old Fitial credit for three days he already served in jail.<\/p>\n<p>The defendant was placed on one year of probation. He was  required to pay a $100 court assessment fee and $100 in annual probation fee.<\/p>\n<p>Manglona ordered Fitial to write a letter of apology and have no further altercations with the 12-year-old child.<\/p>\n<p>Fitial was also directed to perform 200 hours of community work service at a minimum of 10 hours per month.<\/p>\n<p>The judge ordered the defendant to return to court for a review hearing on Dec. 10, 2008 at 9am.<\/p>\n<p>\u201cDefendant\u2019s failure to appear will result in the issuance of a bench warrant,\u201d Manglona said. <\/p>\n<p>The Attorney General\u2019s Office filed the case in 2006. Fitial signed a plea agreement with the government.
