Superior Court associate judge David A. Wiseman has vacated all the hearings in the case against a man who was recently arrested by federal agents based upon an arrest warrant from the State of Nevada for a felony theft case.<\/p>\n
Wiseman issue the order in Ka Cheong Ip\u2019s case after the Office of the Attorney General moved to dismiss the proceedings, vacate bail order, exonerate bail, and vacate the hearing.<\/p>\n
In the government\u2019s unopposed motion, chief prosecutor Michael L. Ernest said the 57-year-old Ip attempted to enter the U.S. and was taken into custody pursuant to a warrant issued on Aug. 28, 2003, by the Justice Court in Las Vegas Township, Clark County Nevada. <\/p>\n
Ernest said the matter was transferred by the federal immigration\/border protection to the CNMI and Ip was brought before the Superior Court on July 12, 2011.<\/p>\n
During that hearing, Wiseman found probable cause to justify Ip\u2019s arrest but allowed him to deposit $5,000 cash with an unsecured bond of $45,000 for his temporary release.<\/p>\n
Tinian Dynasty Hotel & Casino\u2019s general manager Tom Liu acted as third-party custodian for Ip.<\/p>\n
Ernest said that on July 15, 2011, the Office of the Attorney General received a fax from the Clark County District Attorney\u2019s Office stating that they would \u201cbegin formal extradition proceedings to obtain a governor\u2019s warrant.\u201d<\/p>\n
Ernest said that Ip, however, resolved the debt dispute that was the basis for the arrest warrant. <\/p>\n
The chief prosecutor said that, on July 16, 2011, the OAG received another fax stating that \u201cthe Clark County District Attorney\u2019s Office will not extradite Ip back to Nevada. Please release our fugitive hold.\u201d<\/p>\n
Ernest said that on that same day, he spoke with attorney G. Anthony Long, counsel for Ip, and that Long has no objection to his motion.<\/p>\n","protected":false},"excerpt":{"rendered":"
