{"id":155807,"date":"2011-10-12T22:07:00","date_gmt":"2011-10-12T22:07:00","guid":{"rendered":"http:\/\/bd7d483a-1dfb-11e4-aedf-250bc8c9958e"},"modified":"2011-10-12T22:07:00","modified_gmt":"2011-10-12T22:07:00","slug":"bd7d484e-1dfb-11e4-aedf-250bc8c9958e","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/bd7d484e-1dfb-11e4-aedf-250bc8c9958e\/","title":{"rendered":"Ex-detention guard\u2019s sentencing delayed anew"},"content":{"rendered":"<p>Due to objections to the pre-sentence investigation report, the federal court on Tuesday postponed again the sentencing of Tyron Farley Reyes Fitial, a former detention guard who pleaded guilty to enticing an underaged girl.<\/p>\n<p>He will now be sentenced on Nov. 30, 2011 at 9am.<\/p>\n<p>Attorney Joseph Norita Camacho and co-counsel Michael Norita Evangelista had both objected to the pre-sentence investigation report prepared by the U.S. Probation Office.<\/p>\n<p>Camacho pointed out that his client only pleaded guilty to enticing a minor but the pre-sentence report used allegations in two other charges to bolster Fitial\u2019s sentence.<\/p>\n<p>Evangelista told Saipan Tribune that the federal sentencing guidelines gives some fairness in how a defendant is sentenced, so similar offenses are sentenced within a certain range. <\/p>\n<p>\u201cThat is all Tyron [Fitial] is asking, that he be sentenced according to the facts that he pled guilty [to],\u201d Evangelista said.<\/p>\n<p>Fitial\u2019s original sentencing date was July 21, 2011. <\/p>\n<p>Fitial, a former detention guard at the Juvenile Detention Unit, pleaded guilty in April to enticing a minor, but not the actual sexual penetration.<\/p>\n<p>The Office of the Attorney General has filed in the Superior Court 11 criminal charges against Fitial over the same incident. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Due to objections to the pre-sentence investigation report, the federal court on Tuesday postponed again the sentencing of Tyron Farley Reyes Fitial, a former detention guard who pleaded guilty to enticing an underaged girl.<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[],"class_list":["post-155807","post","type-post","status-publish","format-standard","hentry","category-local-news"],"_links":{"self":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/155807","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/comments?post=155807"}],"version-history":[{"count":0,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/155807\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media?parent=155807"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/categories?post=155807"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/tags?post=155807"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
