U.S. District Court for the NMI Chief Judge Ramona V. Manglona has dismissed a lawsuit filed by an investor against attorney Ramon K. Quichocho and landowner Joaquin Q. Atalig.<\/p>\n
Manglona dismissed with prejudice Sin Ho Nam\u2019s lawsuit as well as Quichocho and Atalig\u2019s counterclaims against Nam after the parties agreed for such dismissal.<\/p>\n
The judge ordered each party to bear its own costs and attorneys\u2019 fees.<\/p>\n
Attorney Colin M. Thompson, counsel for Nam, and attorney Michael Dotts, counsel for Quichocho and Atalig, have agreed to dismiss the case.<\/p>\n
Dotts disclosed to Saipan Tribune last month that his clients have settled Nam\u2019s lawsuit.<\/p>\n
landowner Joaquin Q. Atalig have settled the lawsuit filed by investor Sin Ho Nam, who obtained on Thursday a favorable ruling from federal court.<\/p>\n
Attorney Michael Dotts, counsel for Quichocho and Atalig, told Saipan Tribune that the real news is that the case was settled on Friday by District Court Judge Alex Munson who is on island.<\/p>\n
\u201cThe decision actually did not make much of a difference,\u201d said Dotts, referring to a 55-page opinion and order issued by U.S. District Court for the Asked for comment about Bennett\u2019s ruling, Dotts said part of the decision favored Nam and part favored Quichocho.<\/p>\n
Dotts did not discuss the terms of the settlement. <\/p>\n
Nam sued Quichocho and Atalig for breaching a land lease agreement when they terminated a 55-year lease less than two years later despite having already paid $218,000.<\/p>\n
NMI visiting judge Mark W. Bennett found Quichocho and Atalig liable to Nam for breach of contract.<\/p>\n
Bennett in his order stated that Nam\u2019s remedies or question of damages and the entirety of his claim for breach of fiduciary duty against Quichocho will proceed to trial.<\/p>\n","protected":false},"excerpt":{"rendered":"
