Benigno R. Fitial and the Fund.<\/p>\n<p>The Fund\u2019s board and board members Pedro Q. Dela Cruz, Sixto K. Igisomar, and Adelina C. Roberto, through counsel Braddock J. Huesman, asked the U.S. District Court for the NMI to set the hearing because they are not aware of the court\u2019s subsequent ruling regarding a motion.<\/p>\n<p>Huesman said his clients have asked the court to impose sanctions against Bruce Jorgensen, counsel for the unnamed retirees, for filing a motion for an improper purpose in violation of Federal Rule of Civil Procedure.<\/p>\n<p>Specifically, Huesman said, the unnamed retirees claim that the court has already decided the motion in \u201cJorgensen\u2019s favor.\u201d<\/p>\n<p>\u201cThe board is unaware of any such resolution of the motion. In fact, the court\u2019s most recent substantive order, denying the [unnamed plaintiffs\u2019] motion to lift stay, does not address the motion,\u201d the lawyer said.<\/p>\n<p>Currently, Huesman said, there is a March 1, 2012, hearing set for the board\u2019s motion to force Jorgensen to associate with a local lawyer.<\/p>\n<p>Jorgensen, on behalf of the two unnamed retirees, is suing Fitial and the Fund over the alleged non-payment of their retirement benefits.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The NMI Retirement Fund\u2019s board and its three board members have asked the federal court to set a hearing date in connection with the lawsuit filed by two unnamed retirees against Gov.
