{"id":159694,"date":"2012-03-15T20:57:00","date_gmt":"2012-03-15T20:57:00","guid":{"rendered":"http:\/\/bec378e5-1dfb-11e4-aedf-250bc8c9958e"},"modified":"2012-03-15T20:57:00","modified_gmt":"2012-03-15T20:57:00","slug":"bec378fb-1dfb-11e4-aedf-250bc8c9958e","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/bec378fb-1dfb-11e4-aedf-250bc8c9958e\/","title":{"rendered":"Land taking fight, now on 19th year, reaches high court"},"content":{"rendered":"<p>The legal fight of the heirs of Maria Mangabao over the government\u2019s taking of their land in Chalan Kiya in 1993 has now reached the CNMI Supreme Court.<\/p>\n<p>The heirs claimed that until now they have not received a single penny despite a court order. They said the government now owes them $15.8 million, including interest rate at $2,800 daily.<br \/>\nAttorney Edward C. Arriola, who served as counsel for the heirs in their appeal, told the Supreme Court yesterday that the heirs have been deprived of their constitutional right to just compensation.<\/p>\n<p>\u201cMarch 31 this year marks 19 long years of deprivation of their rights for just compensation,\u201d Arriola said.<\/p>\n<p>Assistant attorney general Michael Stanker, counsel for the government, cited a CNMI law that says the judgment may only be paid if the Legislature specifically appropriates money for it. He said the Legislature has failed to do so up to now.<\/p>\n<p>In an interview after the hearing, Arriola said the court has already adjudicated the case, yet despite a court order in which the government consented to the amount, it still refuses to pay the compensation.<\/p>\n<p>\u201cThe issue on appeal is this: Which is the supreme law of the land\u2014the Constitution or the statute?
