A law firm is suing Arctic Circle Air Co. in Superior Court for allegedly failing and refusing to pay $34,626.34 in unpaid legal services. <\/p>\n
The law firm of O\u2019Connor Berman Dotts and Banes, through attorney David G. Banes, sued Arctic Circle Air for breach of contract.<\/p>\n
The law firm is demanding $34,626.34 in general damages, plus interest at the rate of 9 percent per annum, additional attorney\u2019s fees, and court costs.<\/p>\n
Banes stated in the complaint that their law firm was engaged by Arctic Circle Air in August 2011 to render legal services and act as its counsel.<\/p>\n
As part of the agreement, Banes said Arctic Circle Air will pay their law firm attorney\u2019s monthly fees and costs in the course of the legal representation.<\/p>\n
The lawyer said the airline company also agreed to reimburse plaintiff for all out-of-pocket expenses, including filing fees, court costs, travel expenses and duplication charges.<\/p>\n
Banes said their law firm invoiced the company monthly for attorneys\u2019 fees and costs expended on defendant\u2019s behalf.<\/p>\n
The lawyer said that Arctic Circle incurred an unpaid balance totaling $44,626.34, through May 2013, not including interest due.<\/p>\n
Banes said the company made only the initial payment of $10,000 and that despite repeated promises to pay the next installment, defendant has \u201cneglected, failed and refused to pay the second installment.\u201d <\/p>\n
The law firm, through attorney Michael W. Dotts, represented Arctic Circle Air in its lawsuit against the Rhode Island-based Independence Bank over the bank\u2019s demand for payment of $155,000 in \u201cbreak-up fees.\u201d<\/p>\n
In May 2013, Arctic Circle and Independence Bank, reached a settlement on the lawsuit.<\/p>\n
Under the agreement, Arctic Circle agreed to dismiss the lawsuit and pay the bank $70,000. For its part, the bank agreed to release its liens on Arctic Circle\u2019s aircraft.<\/p>\n","protected":false},"excerpt":{"rendered":"
