Roberto, at Parkville Motel in Gualo Rai in 2013.

After the second alleged victim completed her testimony, the prosecution called to the witness stand the third alleged victim.

Roberto’s lead counsel David J. Lujan is expected to continue questioning the third alleged victim when trial resumes today at 10am.

In the continuation of her testimony yesterday morning, the second 16-year-old girl, allegedly tagged by Roberto as “Shy Girl,” mostly replied, “I don’t remember” or “I don’t know” to the questions by the prosecution and defense counsel.

During questioning by Assistant U.S. Attorney Rami S. Badawy, “Shy Girl” said that during the second incident inside the motel room, she went inside the restroom while Roberto and her female friend were in the bedroom.

She said she does not know what Roberto and her friend were doing at the time as it was dark, said “Shy Girl,” who kept fiddling with the microphone and swinging her chair during her testimony.

When asked if she had clothes at that time, “Shy Girl” said she does not remember. She, however, recalled getting on the bed and having sex with Roberto.

She said she later went to the restroom to shower, leaving her friend and Roberto on the bed. The three of them later left the motel and Roberto dropped the two of them in Finasisu, where they were staying at that time.

“Shy Girl” said Roberto gave her and her friend money in that second incident. She said she does not remember the amount. After that incident, she said she did not see Roberto again.

Badawy then asked her about the first incident (alleged foursome) in the same motel with Roberto, reiterating the same questions that “Shy Girl” refused to answer during her testimony last Friday.

This time, “Shy Girl” replied to the questions. She said Roberto did not do anything to her but that she and her friend gave oral sex to Roberto, who was touching the third girl on the bed.

“Shy Girl” said she does not consider oral sex as sex.

When shown a letter dated Aug. 8, 2013, the second alleged victim recognized it as her letter, where she threatened the 41-year-old Roberto and demanded $400 cash from him. “Shy Girl” admitted that she threatened Roberto, but downplayed it as “nothing, it’s just paper.”

She said it was the first alleged victim’s idea to write the letter. She said her friend wrote the letter first, then she copied some of the contents by just changing some words. She said her friend told her that her mother would deliver their separate letters to Roberto.

“Shy Girl” said she got Roberto’s cell phone number because her friend (first alleged victim) used her cell phone in communicating with the defendant.

During cross-examination by Lujan, “Shy Girl” said her friend (the first alleged victim) introduced her to the third girl at school only last year.

“Shy Girl” agreed with Lujan that she did not mention Roberto’s name during several interviews with detectives and Federal Bureau of Investigation agents.

When Lujan asked her to look at a report to refresh her memory, “Shy Girl” said she didn’t want to because she’s tired.

This prompted U.S. District Court for the NMI Chief Judge Ramona V. Manglona to call for a lunch break. After lunch, Lujan continued cross-examining “Shy Girl.”

When the examination of “Shy Girl” was completed, the prosecution called the alleged third victim to the witness stand.

The third alleged victim, who is also 16 years old, recounted her and the two girls’ foursome with Roberto at Parkville Motel last year.

The girl testified that Roberto picked them up in Kagman, brought them to Parkville Motel where they had a foursome, went to a cockpit where the defendant gave them $100 each, and then dropped them off.

When Lujan asked about her stay in a sanctuary in Guam, the third girl replied, “How’s that relevant?”

She agreed with Lujan that Roberto, who she called “Jerald,” never threatened her. She also stated that she was aware of the two letters that her two friends sent to Roberto to demand $400 each.

The third alleged victim said she was not present when her friends wrote the letters. She stated she could not remember how she became aware of the letters.

She said she could not remember telling investigators that her friend (first victim) asked her not to cry after the incident in the motel. She said she also could not recall telling investigators that she asked her friend (first victim) why she left her in bed with Roberto.

Roberto, a former acting director of the Division of Fish and Wildlife, is on trial for three counts of enticing three minors to engage in prostitution and one count of witness tampering.

The second of three alleged victims continued her testimony in federal court yesterday, in which…

[900,4
93,197,51
post-178223","post","type-post","status-publish","format-standard","hentry","category-featured","category-local-news","tag-district-court","tag-gualo-rai","tag-guam
["GET
