Kennedy on Friday remanded Evengelyn E. C. Jones to the custody of the U.S. Marshal, after determining that there is a serious risk that Jones will not appear in court and that no reasonable condition will assure that she will not flee.<\/p>\n<p>Kennedy said Jones, who was arrested by federal agents last week for failing to appear at a hearing, must be given an opportunity to consult privately with her court-appointed counsel.<\/p>\n<p>A violating hearing will be held tomorrow, Tuesday, at 1:30pm.<\/p>\n<p>Court-appointed counsel David Banes appeared at the hearing on Friday. Assistant U.S. attorney Ross Naughton appeared telephonically on behalf of the U.S. government.<\/p>\n<p>U.S. Marshal Don Hall served Jones on Thursday with an arrest warrant that U.S. District Court for the NMI Chief Judge Ramona V. Manglona issued last Jan. 20.<\/p>\n<p>Manglona issued the arrest warrant after Jones failed to show up at her revocation hearing.<\/p>\n<p>Jones was first arrested on an indictment charging her with one count of visa fraud and was released last Nov. 24, 2014, on a $5,000 unsecured bond.<\/p>\n<p>U.S. Probation officer Gregory Arriola then filed a petition for revocation of the defendant\u2019s pre-trial release after she failed to appear for random drug tests on Dec. 16, 18, 20, and 30, 2014.<\/p>\n<p>At the Jan. 20 revocation hearing, Jones did not show up in court.<\/p>\n<p>Banes informed the court that since his appointment last Jan. 9, he has made many attempts to contact his client without success.<\/p>\n<p>This prompted Manglona to order the arrest of Jones and vacated the trial date set for Feb. 2, 2015. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>U.S. District Court for the NMI Magistrate Judge Heather L.
