Manglona has thrown back in prison a former U.S. Customs and Border Protection officer for using methamphetamine or “ice” while on pre-trial release.

Manglona revoked Bob Hajime Deleon Guerrero Yamagishi’s pre-trial release on Wednesday and remanded him into the custody of the U.S. Marshal pending his sentencing, which is on Oct. 30, 2015.

Yamagishi, through court-appointed counsel Janet H. King, waived his right to an evidentiary hearing and admitted to the violation.

King requested that her client be allowed to remain on pre-trial release. She stated that the defense had no objection to place Yamagishi on house arrest.

Assistant U.S. attorney Garth Backe moved to have Yamagishi’s pre-trial release be revoked pending sentencing.

Probation officer Margarita Wonenberg recommended home detention, instead of curfew.

In her petition for revocation, Wonenberg disclosed that Yamagishi tested presumptive positive for “ice” during a urinalysis test last Aug. 11 and Sept. 17.

When confronted with the results, Wonenberg said Yamagishi admitted to smoking the drug on Aug. 6 and Sept. 14.

Yamagishi also failed to attend group counseling at the Marianas Counseling Services. He submitted diluted samples during random urinalysis last Aug. 24, Sept. 3, and 7.

Wonenberg said the diluted samples showed signs of water flushing to evade a positive drug test.

Yamagishi pleaded guilty to two counts of fraud by wire after making illegal cash advance transactions on a travel charge card between July 4 and Aug. 7, 2014.

According to the indictment, Yamagishi, as then-CBP officer, made illegal cash advance transactions 28 times in July 2014 and nine times in August 2014, for a total amount of $6,227.53.

U.S. District Court for the NMI Chief Judge Ramona V.
