A U.S. Marshal agent arrested on Tuesday probationer Ryan Taitano Babauta for allegedly using methamphetamine or \u201cice\u201d and violating other conditions of his probation.<\/p>\n
Taitano was taken to U.S. District Court for the NMI for an initial appearance hearing on Tuesday afternoon.<\/p>\n
Attorney Michael Dotts appeared as court-appointed counsel for Babauta.<\/p>\n
Dotts stated that he has reviewed the U.S. Probation\u2019s petition for revocation of Babauta\u2019s probation but has yet to review it in detail with his client.<\/p>\n
Dotts entered a denial to all the allegations contained in the petition and requested for a preliminary hearing.<\/p>\n
U.S. District Court for the NMI Chief Judge Ramona V. Manglona set the revocation hearing for Dec. 3, 2015, at 1:30pm.<\/p>\n
Manglona informed Babauta of the allegations and the basis for her to issue a warrant for his arrest.<\/p>\n
\u201cYou have a long history of problems,\u201d the judge told Babauta.<\/p>\n
Manglona said she understands that Babauta has a new baby and a job.<\/p>\n
\u201cIt\u2019s up to you. You need to get off of drugs,\u201d the judge said.<\/p>\n
After the hearing, Manglona remanded Babauta into the custody of the U.S. Marshal.<\/p>\n
Assistant U.S. attorney Russell Lorfing appeared for the U.S. government.<\/p>\n
In the petition, U.S. Probation Officer Gregory Arriola said Babauta admitted using \u201cice\u201d on Sept. 30, 2015, as well as on Oct. 14 and 27, 2015.<\/p>\n
Arriola said Babauta also failed to report to the U.S. Probation Office on Sept. 8, 2015, and on Oct. 2 and 5, 2015.<\/p>\n
Babauta also allegedly failed to report to counseling sessions on Oct. 13 and Nov. 4, 5, and 11. He also failed to report for a random drug test on Nov. 3, 7, and 10, 2015.<\/p>\n
The court revoked Babauta\u2019s probation at least twice in the past for using \u201cice\u201d and violating other probation conditions.<\/p>\n
In August 1999, the court slapped Babauta with a 180-month prison sentence and five years of supervised release, for hostage taking and felon in possession of a firearm.<\/p>\n","protected":false},"excerpt":{"rendered":"
