U.S. District Court for the NMI Chief Judge Ramona V. Manglona has ordered probationer Ryan Taitano Babauta to spend six months in prison and six months of home detention for using methamphetamine or \u201cice\u201d and violating other probation conditions.<\/p>\n
At a hearing last Tuesday, Manglona revoked the supervised release of Babauta and ordered that after his release from imprisonment, he will be placed on 40 months of supervised release.<\/p>\n
Babauta was given credit for time served.<\/p>\n
Assistant U.S. attorney Russell Lorfing recommended an imprisonment term of 12 months.<\/p>\n
Attorney Michael Dotts, court-appointed counsel for Babauta, recommended a sentence of six months imprisonment and six months of home confinement.<\/p>\n
Last Nov. 17, a U.S. Marshal agent arrested Babauta after the U.S. Probation filed a petition to revoke his supervised release.<\/p>\n
In the petition, U.S. Probation Officer Gregory Arriola said Babauta admitted to using \u201cice\u201d on once in September and twice in October last year.<\/p>\n
Arriola said Babauta also failed to report to the U.S. Probation Office once in September and twice in October.<\/p>\n
Babauta also failed to report to counseling sessions in October and November and failed to report for a random drug test three times in November.<\/p>\n
The court revoked Babauta\u2019s probation at least twice in the past for using \u201cice\u201d and violating other probation conditions.<\/p>\n
In August 1999, the court slapped Babauta with a 180-month prison sentence and five years of supervised release, for hostage taking and felon in possession of a firearm.<\/p>\n","protected":false},"excerpt":{"rendered":"
