Faris issued Thursday a memorandum of his decision to dismiss the NMI Retirement Fund&#8217;s Chapter 11 bankruptcy petition.<\/p>\n<p>Faris&#8217; memorandum simply reiterated the discussions in his tentative ruling dismissing the Fund&#8217;s bankruptcy case.<\/p>\n<p>Faris ruled that the Fund is a \u201cgovernmental unit\u201d and not eligible for relief under Chapter 11 of the Bankruptcy Code.<\/p>\n<p>The judge pointed out, however, that some administrative issues must be resolved in conjunction with the dismissal of the case.<\/p>\n<p>Faris gave all professionals retained by the Fund and any other party wishing to assert an administrative expense to file an application or motion no later than June 29, 2012.<\/p>\n<p>Faris directed the Fund to give notice of all such applications and motions.<\/p>\n<p>\u201cThe notice shall provide that, if an objection to any such application or motion is filed by a date certain (which shall be not sooner than 14 days after notice is given), the court will consider the contested application or motion at a hearing on July 27, 2012, at 9:30am, and that, if no timely objection is filed to any of the applications or motions, the court will consider the uncontested applications and motions without a hearing,\u201d the judge said.<\/p>\n<p>Faris said the order dismissing the case will be entered after orders on the applications and motions are entered and all approved compensation, reimbursement, and administrative expenses are paid.<\/p>\n<p>Faris said when he enters the order dismissing the case, he will also enter orders dismissing without prejudice all adversary proceedings and remanding all removed proceedings.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dismissal order will be entered after all expenses are paid By Ferdie de la Torre&#8230;<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[],"class_list":["post-21876","post","type-post","status-publish","format-standard","hentry","category-local-news"],"_links":{"self":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/21876","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/comments?post=21876"}],"version-history":[{"count":0,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/21876\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media?parent=21876"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/categories?post=21876"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/tags?post=21876"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
