Superior Court Associate Judge Joseph N. Camacho has dismissed the criminal charge against suspected methamphetamine or \u201cice\u201d trafficker Joshua Sablan Diaz.<\/p>\n
Following the Office of the Attorney General\u2019s request on Thursday, Camacho dismissed without prejudice the first amended information charging the 30-year-old Diaz with illegal possession of a controlled substance.<\/p>\n
Dismissal without prejudice means the government may re-open the case in the future.<\/p>\n
Acting chief prosecutor Chester Hinds said the government believes \u201cit is in the interest of justice\u201d to dismiss this case without prejudice.<\/p>\n
Hinds did not specifically indicate the reason.<\/p>\n
Attorney Vicente T. Salas, counsel for Diaz, did not oppose the government\u2019s motion.<\/p>\n
According to the charging document, Diaz unlawfully possessed \u201cice\u201d on Dec. 23, 2015 on Saipan.<\/p>\n
Diaz was a passenger of a car driven by Li Qiran, a Chinese man who was pulled over by a police detective on the road in Garapan allegedly for being wanted by International Police. <\/p>\n
When the officers patted down Qiran and Diaz, officers allegedly found a clear Ziploc bag containing 0.3 gross grams of methamphetamine.<\/p>\n
Police detective Jesse Dubrall allegedly found underneath the driver\u2019s seat a bag containing Ziploc baggies with crystal-like substance and green leafy substance believed to be marijuana.<\/p>\n
Diaz has pending \u201cice\u201d trafficking charges.<\/p>\n
Diaz surrendered to police last May 19 after the Department of Public Safety sought police\u2019s assistance in locating him for allegedly involving in \u201cice\u201d trafficking.<\/p>\n
Police detective Jeffrey I. Norita stated in his report that their \u201ccooperating source\u201d managed to buy $50 worth of \u201cice\u201d from Diaz, who was in a vehicle with another person, in the parking lot of Dolphin\u2019s Wholesale in San Jose on March 17, 2015.<\/p>\n
Norita said the same \u201ccooperating source\u201d also managed to purchase $100 more worth of \u201cice\u201d from Diaz, who was in a vehicle with another man, in the parking lot of Garage Sale in San Jose on March 18, 2015.<\/p>\n
