{"id":233647,"date":"2016-08-04T06:00:36","date_gmt":"2016-08-03T20:00:36","guid":{"rendered":"http:\/\/www.saipantribune.com\/?p=233647"},"modified":"2016-08-04T06:00:36","modified_gmt":"2016-08-03T20:00:36","slug":"man-threw-chair-cop-rota-bar-gets-30-day-prison-term","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/man-threw-chair-cop-rota-bar-gets-30-day-prison-term\/","title":{"rendered":"Man who threw chair at cop on Rota bar gets 30-day prison term"},"content":{"rendered":"<p>A 20-year-old man accused of breaking several items at a bar, pushing and yelling at his father, and throwing a chair at a police officer on Rota, entered a guilty plea yesterday in the Superior Court and was slapped with a 30-day prison term.<\/p>\n<p>Raymond D. Castro Jr. pleaded guilty to the offense of assault and battery.<\/p>\n<p>Associate Judge Joseph N. Camacho accepted the plea agreement and Castro\u2019s guilty plea.<\/p>\n<p>Camacho sentenced Castro to one-year imprisonment, the first 30 days to be served day for day, without the possibility of parole and early release.<\/p>\n<p>The defendant was given credit for 15 days for time served. <\/p>\n<p>Camacho said the suspended sentence may be imposed in whole or in part for violation of law or Office of the Adult Probation rules.<\/p>\n<p>After completing the prison term, Castro will be placed on supervised probation for two years, to run concurrent to his probation in his previous conviction. <\/p>\n<p>Castro was ordered to pay $25 in court costs and $200 in probation fee.<\/p>\n<p>During the probationary period, the defendant will be prohibited from possessing or consuming any alcoholic beverages.<\/p>\n<p>Restitution will be determined, if there is any, within 90 days.<\/p>\n<p>Camacho noted that Castro has a prior conviction.<\/p>\n<p>Camacho said it is the Office of the Attorney General that decides what charges to file and the court can only hear the case and charge.<\/p>\n<p>Last May 4, OAG filed an information charging Castro with two counts of assault and battery, and one count of criminal mischief.<\/p>\n<p>Last July 26, OAG amended the information charging the defendant with only one count of assault and battery.<\/p>\n<p>Assistant public defender Tillman Clark, counsel for Castro, stated that OAG cannot prove the other charges that is why they were dropped.<\/p>\n<p>According to the factual basis of the plea agreement, Castro struck Police Officer Joseph Q. Camacho with a chair on May 2, 2016, on Rota.
