The two charges carry a maximum penalty of one year and six months imprisonment. <\/p>\n<p>Barcinas dropped the disturbing the peace charge, leaving only the assault and battery charge. That carries a maximum penalty of one year imprisonment.<\/p>\n<p>Barcinas said he disturbing the peace charge was dropped for purposes of non-trial disposition.<\/p>\n<p>The 38-year-old Kaipat has pleaded not guilty. The bench trial will be on May 15, 2017. <\/p>\n<p>Kaipat allegedly hit his wife several times on the head and body last Jan. 13.<\/p>\n<p>Police officers responded to the Truongs parking lot on Beach Road in Susupe at 11:18pm after receiving a call about a disturbing the peace incident.<\/p>\n<p>A police detective saw Kaipat on top of his wife on the passenger side seat of a Nissan Altima car. Kaipat was reportedly holding down his wife\u2019s head on the seat. The wife was stepping on the car\u2019s horn, causing it to honk several times.<\/p>\n<p>The couple had just come from a party for patrol officers at a hotel.
