A company that lost a bid for an exclusive quarry permit on a public land in As Matuis is suing to stop the Department of Public Lands from awarding the permit.<\/p>\n
USA Fanter Corp. Ltd., through counsel Robert T. Torres, wants the Superior Court to direct DPL and USA Fanter to negotiate on a quarry permit. If the two could not come to an agreement, only then would Fanter not block the awarding of the quarry permit.<\/p>\n
In the complaint filed Friday, it said that DPL issued a request for proposal titled \u201cQuarry Operator on Public Lands-Lot Number 011 C 02\u2014As Matuis, Saipan.\u201d The lot contains 50,000 square meters.<\/p>\n
Fanter, which already has a quarry in Kannat Tabla, submitted a proposal in response on Sept. 16, 2016.<\/p>\n
Fanter was then informed on Nov. 9, 2016, that its proposal had not been selected.<\/p>\n
Instead, DPL initially selected the proposal submitted by Win Win Way Construction Co. and issued a notice of intent to award to Win Win Way on Nov. 9, 2016, Torres said.<\/p>\n
Torres said DPL then entered into negotiations with Win Win Way for a contract for the quarry permit.<\/p>\n
However, Torres said, the parties were unable to agree on terms and that Win Win Way withdrew from consideration for the permit on May 23, 2017.<\/p>\n
The lawyer said unable to negotiate a contract for the permit with Win Win Way, DPL then turned to Blue Oasis LLC, the second highest bidder.<\/p>\n
He said DPL and Blue Oasis were also unable to agree to a contract.<\/p>\n
Torres said that DPL chose to disregard Fanter\u2019s proposal, with DPL issuing another RFP for the same land on or before Sept. 21, 2017.<\/p>\n
Last Oct. 1, Fanter protested the apparent cancellation of the previous RFP, to which DPL, through its counsel, reaffirmed its non-award to the company. Torres said DPL\u2019s response did not cite a reason. <\/p>\n
