The husband and parents of a woman who was killed after being hit by a minivan as she was crossing Chalan Monsignor Guerrero Road in front of Twins Supermarket in Lower Dandan last Dec. 18 are suing.<\/p>\n
Bernardino Lozada filed the lawsuit, representing his dead wife, Angelita D. Lozada, and her parents, Juanito and Jovita Dela Cruz.<\/p>\n
Lozada and the Dela Cruzes, through counsel David G. Banes, are suing the driver, Guo Guozhen, and his employer.<\/p>\n
The Lozadas and Dela Cruzes are going to amend the complaint once they are able to identify Guozhen\u2019s employer.<\/p>\n
The Lozadas and Dela Cruzes asked the Superior Court to hold the defendants liable to pay them damages, court costs, and attorney\u2019s fees.<\/p>\n
According to a police report, the 48-year-old victim, a Filipino national, was pronounced dead by a doctor at the Commonwealth Health Center on Dec. 18, 2017.<\/p>\n
Police said the driver stated that he did not see the victim, who was not in a designated crosswalk. Investigators have ruled out alcohol as a factor in the accident. <\/p>\n
Banes stated in the complaint that Mrs. Lozada was crossing Chalan Monsignor Guerrero Road in front of Twins Supermarket at 5:20am when a white 2016 Honda Odyssey driven by Guozhen was on the eastbound lane to drop off two customers at the airport. The car suddenly hit Mrs. Lozada, resulting in her fatal injuries. An ambulance brought her to the Commonwealth Health Center, where she was pronounced dead that same day.<\/p>\n
Banes said Guozhen was speeding as he was in a hurry to drop off the two customers at the airport.<\/p>\n
Banes said Guozhen\u2019s gross negligence and reckless disregard for Mrs. Lozada\u2019s safety caused her death.<\/p>\n
Banes said Guozhen\u2019s employer is liable because at the time Mrs. Lozada was struck, Guozhen was driving during the course and scope of his employment.<\/p>\n","protected":false},"excerpt":{"rendered":"
