Bogdan found that three counts of illegal possession of a controlled substance are multiplicitous as to three counts of trafficking of a controlled substance, at least in part because defendant could not sell the methamphetamine during the controlled-buys to the CNMI government\u2019s confidential informant without being in actual possession of \u201cice.\u201d<\/p>\n<p>Bogdan, however, emphasized that the same conclusion cannot be made for the 7th and 8th counts charging Yu with trafficking of a controlled substance and illegal possession of a controlled substance because they relate to a separate search of Hu\u2019s residence and were not the result of her direct effort to sell \u201cice\u201d to an informant.<\/p>\n<p>\u201cThe underlying facts and circumstances of that search are more legally equivocal, especially given the amount of methamphetamine allegedly discovered,\u201d said Bogdan in granting Hu\u2019s motion to consolidate the multiplicitous charges. <\/p>\n<p>Assistant public defender Nancy Dominski is counsel for Hu. Assistant attorney general Chester Hinds argued as counsel for the government at the hearing. <\/p>\n<p>Bogdan ordered the government to amend the information, electing between three counts of trafficking or three counts of illegal possession.<\/p>\n<p>With respect to the 7th and 8th counts charging Hu with trafficking and illegal possession, Bogdan said a violation of Hu\u2019s constitutional rights is not likely to occur if the jury is informed at trial that the Commonwealth charged her with both possession and trafficking of a controlled substance for the \u201cice\u201d allegedly discovered at her home.<\/p>\n<p>Instead, the judge noted, this search stands alone and distinct from the controlled buys and could conceivably\u2014depending on the amount of methamphetamine proven to exist at trial\u2014result in either simple possession conviction or result in a trafficking conviction under the rebuttal presumption of trafficking option created in a statute.<\/p>\n<p>The CNMI Drug Enforcement Task Force arrested Hu in Dandan in  May 2017 for allegedly selling and yielding 100 grams of \u201cice\u201d worth $40,000 to $50,000 during \u201cbuy-walk operations\u201d on Saipan.<\/p>\n<p>Hu, 36, a female but known as Brother, pleaded not guilty. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Three of the eight charges filed against a woman suspected as a distributor of methamphetamine&#8230;<\/p>\n","protected":false},"author":23,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[1539,26,14555],"class_list":["post-272848","post","type-post","status-publish","format-standard","hentry","category-local-news","tag-chester-hinds","tag-cnmi","tag-nancy-dominski"],"_links":{"self":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/272848","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/users\/23"}],"replies":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/comments?post=272848"}],"version-history":[{"count":0,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/272848\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media?parent=272848"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/categories?post=272848"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/tags?post=272848"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
