{"id":284069,"date":"2018-09-07T06:06:38","date_gmt":"2018-09-06T20:06:38","guid":{"rendered":"https:\/\/www.saipantribune.com\/?p=284069"},"modified":"2018-09-07T06:06:38","modified_gmt":"2018-09-06T20:06:38","slug":"lawsuit-against-cnmi-govt-dismissed","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/lawsuit-against-cnmi-govt-dismissed\/","title":{"rendered":"Lawsuit against CNMI govt dismissed"},"content":{"rendered":"<p>The lawsuit filed against the CNMI by a man who was injured in an accident involving a government vehicle back in 2015 was dismissed without prejudice last Wednesday. <\/p>\n<p>Superior Court Associate Judge Joseph Camacho granted the Commonwealth\u2019s motion to dismiss the case without prejudice based on deficiencies found in Palacios\u2019 notice of claims.<\/p>\n<p>Palacios sued the CNMI after a government vehicle that was being driven by John Duenas San Nicolas allegedly caused Palacios several injuries. <\/p>\n<p>However, Palacios failed to provide a sum for monetary damages to accompany the notice of claims that he filed with the Office of the Attorney General. <\/p>\n<p>Dismissed without prejudice means Palacios is allowed to re-file the case, to make it compliant with the Government Liability Act. <\/p>\n<p>The Government Liability Act governs claims against the Commonwealth government. <\/p>\n<p>Palacios has since been granted 60 days to resubmit his claim to the Attorney General\u2019s Office. <\/p>\n<p>Palacios filed the lawsuit against John Duenas San Nicolas in 2015 over a vehicular accident that happened along Chalan Pale Arnold Road on May 27, 2014.<\/p>\n<p>According to the lawsuit, Palacios was traveling south on the inner lane of Chalan Pale Arnold and was turning left to the Commonwealth Health Center.<\/p>\n<p>San Nicolas, who was driving a government vehicle, was allegedly travelling very fast and hit Palacios\u2019 vehicle.<\/p>\n<p>Palacios sued San Nicolas for reckless, careless, and negligent driving.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The lawsuit filed against the CNMI by a man who was injured in an accident&#8230;<\/p>\n","protected":false},"author":24,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[2626,26,12734,259],"class_list":["post-284069","post","type-post","status-publish","format-standard","hentry","category-local-news","tag-attorney-general","tag-cnmi","tag-government-liability-act","tag-lawsuit"],"_links":{"self":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/284069","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/users\/24"}],"replies":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/comments?post=284069"}],"version-history":[{"count":0,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/284069\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media?parent=284069"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/categories?post=284069"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/tags?post=284069"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
