Yaquinto and CUC have agreed to dismiss all their claims and counterclaims that they have asserted against each other.<\/p>\n<p>CUC, through counsel James S. Sirok, and Yaquinto, through counsel Joseph E. Horey, notified yesterday the U.S. District Court for the NMI about their agreement for dismissal with prejudice.<\/p>\n<p>Dismiss with prejudice means the parties can no longer re-file their claims and counterclaims.<\/p>\n<p>Yaquinto and CUC have agreed to bear his or its own attorneys\u2019 fees and court costs.<\/p>\n<p>Last September, U.S. District Court for the NMI Chief Judge Ramona Manglona set the matter for an early settlement conference to Jan. 22, 2019 before Magistrate Judge Heather L. Kennedy.<\/p>\n<p>Yaquinto filed in December 2017 a discrimination lawsuit against CUC and five unnamed co-defendants over his termination as chief financial officer in May 2016 allegedly without cause and without the authority to do so.<\/p>\n<p>CUC then filed a counterclaim against Yaquinto for alleged unauthorized overtime pay, unauthorized wire transfers, and unsupported moving expenses.<\/p>\n<p>CUC asked the court to hold Yaquinto liable to pay back the $49,399 in unauthorized overtime payments, damages representing wire transfer costs, $10,000 in moving expenses, as well as court costs, expert fees, and attorney\u2019s fees.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Former Commonwealth Utilities Corp. chief financial officer Matthew J.
