The federal court last April 12 dismissed with finality a lawsuit filed by an employee of Imperial Pacific International Holdings Ltd., who alleged that he ws injured when a cup of hot coffee he was holding spilled on his hand after an elevator shook violently in a bank\u2019s building in Garapan. <\/p>\n
The dismissal is with prejudice, which means Randyl W. Kruid can no longer re-file his lawsuit against BankGuam Holding Co. and the Connecticut-based Otis Elevator Co.<\/p>\n
U.S. District Court for the NMI designated Judge Frances M. Tydingco-Gatewood dismissed all of Kruid\u2019s claims at the parties\u2019 request to drop the case.<\/p>\n
Bruce Berline is counsel for Kruid. Thomas E. Clifford and Daniel T. Guidotti are counsel for BankGuam Holding Co. and Otis Elevator Co., respectively.<\/p>\n
Parties on both sides agreed on a settlement last month. <\/p>\n
Kruid was demanding damages.<\/p>\n
Imperial Pacific was leasing office space on the fourth floor of the Bank of Guam building. Kruid, a resident of South Dakota, worked at Imperial Pacific\u2019s offices on the fourth floor.<\/p>\n
According to Kruid, he was on his way to the IPI office early in the morning of Nov. 22, 2017, when the elevator allegedly shook, causing the cup of hot coffee he was holding to spill on the back of his left hand. <\/p>\n","protected":false},"excerpt":{"rendered":"
