{"id":301036,"date":"2019-06-06T06:06:29","date_gmt":"2019-06-05T20:06:29","guid":{"rendered":"https:\/\/www.saipantribune.com\/?p=301036"},"modified":"2019-06-06T06:06:29","modified_gmt":"2019-06-05T20:06:29","slug":"uscis-to-nix-petitions-with-no-us-office-address","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/uscis-to-nix-petitions-with-no-us-office-address\/","title":{"rendered":"USCIS to reject petitions with no US office address"},"content":{"rendered":"<p>On Aug. 5, U.S. Citizenship and Immigration Services will begin rejecting\u00a0Form I-129 petitions (Petition for a Nonimmigrant Worker) that do not include the petitioner\u2019s or applicant\u2019s name and primary U.S. office address in Part 1 of Form I-129.<\/p>\n<p>USCIS currently rejects Form I-129 for several reasons. These include, but are not limited to, lack of signature, incorrect fees, or unauthorized third party signing on behalf of the petitioner.\u00a0<\/p>\n<p>DHS regulations require every form to be submitted in accordance with the form instructions, and allow USCIS to reject any benefit request that is not filed in compliance with the regulations governing the specific benefit request.<\/p>\n<p>The petitioner\u2019s or applicant\u2019s primary U.S. office address in Part 1 of Form I-129 must not be the address of the petitioner\u2019s or applicant\u2019s outside counsel or clients. Failure to include the petitioner\u2019s or applicant\u2019s name or providing the address of the petitioner\u2019s or applicant\u2019s outside counsel or clients in Part 1 creates unnecessary delays in the adjudication of Form I-129 and may result in its rejection.<\/p>\n<p>The\u00a0Instructions for Form I-129\u00a0state, in relevant part: Petitioner Information: Complete the \u201cLegal Name of Petitioner\u201d field (if the petitioner is an individual person or a company or organization). For mailing address, list the address of the\u00a0petitioner\u2019s primary office\u00a0within the United States.\u00a0<\/p>\n<p>In many instances, the petitioner\u2019s or applicant\u2019s primary U.S. office address will determine the filing jurisdiction. Information about where to file Form I-129 is available on the\u00a0Direct Filing Addresses for Form I-129, Petition for a Nonimmigrant Worker page.<\/p>\n<p>Form I-129 petitions that USCIS rejects due to missing information can generally be refiled with the required information and fee.
