U.S. Citizenship and Immigration Services is reminding employers of\u00a0the\u00a0Commonwealth of\u00a0the\u00a0Northern Mariana Islands Transitional Workers, or CW-1, that they must confirm the continued employment of the CW-1 workers every six months.<\/p>\n
USCIS\u00a0created a new\u00a0standalone form,\u00a0Form I-129CWR, Semiannual Report for CW-1 Employers,\u00a0for\u00a0this requirement.\u00a0USCIS established\u00a0this requirement\u00a0in an\u00a0interim final rule\u00a0implementing the\u00a0Northern Mariana Islands U.S. Workforce Act of 2018.\u00a0The IFR established\u00a0that the semiannual report is required for all CW-1 petitions approved by USCIS with employment start dates in fiscal year 2020 for a validity period of six months or more.\u00a0<\/p>\n
For\u00a0approved\u00a0petitions with start dates from Oct. 1, 2019, through Dec. 18, 2019, CW-1 employers\u00a0had\u00a0until Aug. 17, 2020,\u00a0to file Form I-129CWR as required in the IFR.\u00a0On\u00a0Sept. 1, USCIS\u00a0began\u00a0issuing Notices of Intent to Revoke for\u00a0CW-1 employers who\u00a0have not\u00a0filed\u00a0a required\u00a0Form I-129CWR\u00a0and are\u00a0now overdue.<\/p>\n
Employers can verify if USCIS received the Form I-129CWR by entering the receipt number of the approved Form I-129CW petition in\u00a0Case Status Online.<\/p>\n
USCIS reminds all CW-1 employers that during the validity of the petition, they must file Form I-129CWR\u00a0with USCIS every six months after the petition validity start date, and that\u00a0USCIS may revoke\u00a0an\u00a0employer\u2019s approved petition or deny their future petitions if they do not comply with the reporting requirement.\u00a0No additional documentary evidence should be submitted with Form I-129CWR.\u00a0Any\u00a0additional documentary evidence\u00a0that is submitted\u00a0with Form I-129CWR\u00a0will not relieve\u00a0an\u00a0employer of the CW-1 document retention requirements and could be subject to shredding\/destruction.\u00a0(PR)<\/p>\n","protected":false},"excerpt":{"rendered":"
