{"id":335996,"date":"2020-12-31T06:05:43","date_gmt":"2020-12-30T20:05:43","guid":{"rendered":"https:\/\/www.saipantribune.com\/?p=335996"},"modified":"2020-12-31T06:05:43","modified_gmt":"2020-12-30T20:05:43","slug":"fed-court-takes-usa-fanter-bid-for-judgment-into-consideration","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/fed-court-takes-usa-fanter-bid-for-judgment-into-consideration\/","title":{"rendered":"Fed court takes USA Fanter bid  for judgment into consideration"},"content":{"rendered":"<p>The U.S. District Court for the NMI has placed under advisement USA Fanter Corp.\u2019s motion for final judgment of over $2 million against the Saipan casino licensee.<\/p>\n<p>This comes soon after USA Fanter filed a motion for summary judgment and final judgement order in the amount of $2,089,345.28 against Imperial Pacific International (CNMI) LLC before Chief Judge Ramona V. Manglona issues a written order.<\/p>\n<p>Manglona earlier granted USA Fanter\u2019s mechanic\u2019s lien petition in the amount of $2,089,345.28 against IPI. That was in September 2020. <\/p>\n<p>A mechanic\u2019s lien is a guaranteed payment to builders, contractors, and construction firms and also ensures that the that party is paid before anyone else in the event of a liquidation.<\/p>\n<p>USA Fanter claims that IPI has only paid it $300,000 to date.<\/p>\n<p>USA Fanter, through Colin Thompson, is suing IPI for not paying the full amount due them under a construction contract for labor and material provided for the improvement of IPI\u2019s property.<\/p>\n<p>According to the lawsuit, IPI fell behind on paying invoices from USA Fanter because IPI did not pay the agreed upon down payment. Despite promises it made to pay, IPI failed to make the payments required under the contract.
