A woman involved in a drug case has asked the court to modify her bail conditions to allow her to have contact with her husband who is involved in another pending drug case. <\/p>\n
Jashlie Nicole Camacho Reyes, 28, has requested the Superior Court to allow her to have contact with her husband and the father of five of her six children.<\/p>\n
Reyes\u2019 attorney, Joe W. McDoulett, told the court that his client has been restricted from contact with her husband, which constitutes to deprivation of her liberty. McDoulett argues that his client is entitled to a preliminary hearing examination.<\/p>\n
McDoulett said Reyes should not be subjected to the substantial deprivation of her liberties while the government prepares for trial.<\/p>\n
\u201cThe purpose of a preliminary hearing is to determine whether there is probable cause to believe that a crime has been committed and that the defendant has committed it,\u201d he said. <\/p>\n
McDoulett said the government should meet its burden to show it can prove probable cause as to all elements of the alleged offenses.<\/p>\n
\u201cTo date, the government has provided evidence only that an amount of a controlled substance was sent to the CNMI. There has been no evidence tying the defendant to the original act of causing the substance to enter the CNMI. Nor has there been any evidence to show the defendant took control of or expected the package to be delivered to her,\u201d he said. <\/p>\n
Superior Court Associate Judge Wesley Bogdan directed the parties in the case to file additional briefs regarding Reyes\u2019 request to modify her release conditions. <\/p>\n
Reyes allegedly imported methamphetamine or \u201cice\u201d from California to Saipan through the U.S. Postal Service.<\/p>\n
She was charged with importation of contraband and trafficking of a controlled substance.<\/p>\n
