As of May 25, former Eucon teacher Yantao Xia\u2019s settlement conference with Eucon International School is scheduled to continue in the U.S. District Court for the NMI before Magistrate Judge Heather L. Kennedy on July 7.<\/p>\n
The settlement is an attempt for both sides to reach a mutually agreeable resolution of their dispute without having to proceed to a trial.<\/p>\n
Xia, who is representing himself in this case, initially filed a complaint against his former employer on Feb. 17, alleging two breaches of contract, violations of the CNMI Minimum Wage and Hour Act and Fair Labor Standards Act, and fraud.<\/p>\n
According to Saipan Tribune archives, Eucon allegedly required Xia to pay fees to a person named \u201cRapture,\u201d who was allegedly an agent of Eucon, for his visa application. Xia claimed that his visa processing was handled by \u201cEucon or Eucon\u2019s agents,\u201d and that the $2,350 he paid in visa processing fees went to Hsieh- Kan Christian Wei, who managed Eucon at the time. <\/p>\n
The settlement conferences between the former teacher and the school first began on May 14. Eucon is represented by Colin M. Thompson.<\/p>\n
Eucon, through Thompson, filed its answer to Xia\u2019s complaint in the district court on March 15. Eucon admitted to multiple allegations in Xia\u2019s complaint, namely facts Xia presented regarding his employment terms and scope of work, the terms of Xia\u2019s first and second employment contracts, and the terms related to Xia\u2019s wages. Eucon also admitted to Xia\u2019s claim that \u201cRapture\u201d was \u201can agent of Eucon and within the scope of his agency with Eucon.\u201d<\/p>\n
Eucon, however, denied many of Xia\u2019s other allegations. Eucon denied that Xia\u2019s processing was handled by Eucon or agents of Eucon, that \u201cRapture\u201d required Xia to pay $2,350 to Eucon manager Wei, and denied the breaches of contract and labor law violations that Xia alleged.<\/p>\n","protected":false},"excerpt":{"rendered":"
