{"id":375358,"date":"2022-09-05T06:06:04","date_gmt":"2022-09-04T20:06:04","guid":{"rendered":"https:\/\/www.saipantribune.com\/?p=375358"},"modified":"2022-09-05T06:06:04","modified_gmt":"2022-09-04T20:06:04","slug":"man-found-guilty-of-shattering-cpa-cops-window-sues-cpa","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/man-found-guilty-of-shattering-cpa-cops-window-sues-cpa\/","title":{"rendered":"Man found guilty of shattering CPA cop\u2019s window sues CPA\u00a0\u00a0"},"content":{"rendered":"<p>A man who was found guilty of shattering a Commonwealth Ports Authority officer\u2019s car window has filed a lawsuit against the officer with the District Court for the NMI alleging excessive force.\u00a0<\/p>\n<p>Shanguo Zhang, who was previously found guilty of vandalism for shattering a CPA officer\u2019s car window with a rock, is suing Ports Police officer Jason Cruz, in his individual capacity for excessive force.\u00a0<\/p>\n<p>Recently, District Court for the NMI Chief Judge Ramona V. Manglona found that Zhang\u2019s complaint has sufficiently stated a plausible Section 1983 excessive force claim for monetary damages against Cruz.\u00a0<\/p>\n<p>In his complaint, Zhang asserted 42 U.S.C. \u00a7 1983 claims for false arrest, excessive force, and deliberate indifference in violation of the Fourth, Eighth, and Fourteenth Amendments.<\/p>\n<p>Zhang, who is homeless, alleged that on Jan. 27, 2020, he was arrested by a police officer whose identity was not known at the time.<\/p>\n<p>The officer did not give him a written document for his arrest, but he was detained for 94 days in prison, Zhang said.<\/p>\n<p>Then in June 2021, he said he was again arrested several times at the Saipan airport by police officers stationed there.\u00a0<\/p>\n<p>Specifically, on June 4, 2021, he was arrested by officers Timothy Cruz and Frank Indalecio; on June 10, 2021, he was arrested by Stevie Cabrera and Timothy Cruz; and on June 14, 2021, he was arrested by Stevie A. Cabrera.<\/p>\n<p>According to Zhang, for each of these arrests, he did not commit any offense, and the officers arrested him intentionally to harass him and to deprive him of his rights<\/p>\n<p>After each arrest, Zhang said he was placed in prison for a short period of time and released without being charged.<\/p>\n<p>On June 15, 2021, Zhang threw a rock at a window at the Saipan airport to protest his mistreatment and then presented himself to be arrested.<\/p>\n<p>Zhang\u2019s complaint stated that officer Jason Cruz used force and violently pulled Zhang to the ground, even though Zhang was not resisting, resulting in physical injuries to Zhang.<\/p>\n<p>He said officers confiscated his signboards and never returned them to him.\u00a0<\/p>\n<p>While in prison, Zhang said he was mistreated, assaulted twice, and did not receive the medical treatment that he needed, including for a fever above 40 degrees Celsius.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A man who was found guilty of shattering a Commonwealth Ports Authority officer\u2019s car window&#8230;<\/p>\n","protected":false},"author":24,"featured_media":360666,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[124],"class_list":["post-375358","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-local-news","tag-cpa"],"_links":{"self":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/375358","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/users\/24"}],"replies":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/comments?post=375358"}],"version-history":[{"count":0,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/375358\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media\/360666"}],"wp:attachment":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media?parent=375358"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/categories?post=375358"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/tags?post=375358"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
