I thought I was going to die that night,\u201d said the 22-year-old Jerry J. Sammy, who took the witness stand during yesterday\u2019s start of the jury trial of Borja.<\/p>\n<p>Sammy said he and some friends had been drinking on the evening of Jan. 4, 2012, when they proceeded to western Garapan. Sammy said he saw Borja near a store and asked him for a cigarette. He said it was his first time to met Borja.<\/p>\n<p>Sammy said Borja replied that he had no cigarettes.<\/p>\n<p>Sammy said he may have said something that offended Borja, who left and then returned and pointed a gun at his head. The alleged victim said Borja asked him if he wanted to die.<\/p>\n<p>During cross-examination by defense counsel Daniel Guidotti, Sammy said he did not recall telling the police during interview that he saw Borja had cigarettes. <\/p>\n<p>Sammy said he also could not remember swearing at Borja.<\/p>\n<p>Sammy admitted that he was convicted in 2009 for breaking into Jonny\u2019s Bar and Grill in Garapan.<\/p>\n<p>When Guidotti showed a Superior Court\u2019s order, he corrected that he was actually convicted in July 2010 and was slapped with six months in prison.<\/p>\n<p>Sammy also denied that he was still on probation when the incident with Borja happened.<\/p>\n<p>But when Guidotti showed him the same court order, Sammy admitted he was indeed under probation at that time.<\/p>\n<p>Before Sammy\u2019s testimony, assistant attorney general Chemere McField called police detective Elias Saralu and evidence custodian Marylou Tanaka.<\/p>\n<p>Saralu testified that he responded to the scene after he was dispatched to the Paseo de Marianas that night of Jan. 4, 2012.<\/p>\n<p>Saralu said it was the 911 caller, a security guard, who handed him the Ruger P89 9mm handgun that was allegedly recovered from Borja.<\/p>\n<p>Saralu said the handgun had no bullet.<\/p>\n<p>Saralu said the alleged victim identified Borja in a six-photo lineup that he showed him.<\/p>\n<p>The government earlier dropped the charge of unlawful possession of a firearm against Borja.<\/p>\n<p>The jury trial is proceeding with the remaining charges of assault with a dangerous weapon and disturbing the peace.<\/p>\n<p>Borja is presently out on bail.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A man testified yesterday how terrified he was when Ji Jing Borja allegedly pointed a&#8230;<\/p>\n","protected":false},"author":23,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[648],"class_list":["post-39645","post","type-post","status-publish","format-standard","hentry","category-local-news","tag-weapon"],"_links":{"self":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/39645","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/users\/23"}],"replies":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/comments?post=39645"}],"version-history":[{"count":0,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/39645\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media?parent=39645"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/categories?post=39645"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/tags?post=39645"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
