{"id":400762,"date":"2023-10-24T14:00:00","date_gmt":"2023-10-24T14:00:00","guid":{"rendered":"https:\/\/www.saipantribune.com\/?p=400762"},"modified":"-0001-11-30T00:00:00","modified_gmt":"-0001-11-29T14:00:00","slug":"Kan-Pacific-granted-writ-to-sell-IPI-property","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/Kan-Pacific-granted-writ-to-sell-IPI-property\/","title":{"rendered":"Kan Pacific granted writ to sell IPI property"},"content":{"rendered":"<p>The U.S. District Court for the NMI has granted Kan Pacific Saipan Ltd.\u2019s request for a writ of execution that authorizes it to sell Imperial Pacific International (CNMI) LLC property to satisfy an over $600,000 court judgment.<\/p>\n<p>Chief Judge Ramona V. Manglona granted last Friday Kan Pacific\u2019s application for a writ of execution on IPI\u2019s personal property to satisfy a judgment of $697,801.30 plus post-judgment interest.<\/p>\n<p>Specifically, Kan Pacific is now authorized to seize and sell IPI vehicles, liquor, the crystal dragons that decorate its cavernous lobby, casino-related equipment, and more.<\/p>\n<p>\u201cThe court grants Kan Pacific\u2019s application. It is therefore ordered that the clerk issue the writ of execution to the U.S. Marshal for the seizure of IPI\u2019s vehicles, IPI\u2019s liquor, IPI\u2019s dragons, IPI\u2019s computer hardware, IPI\u2019s furniture, and equipment, IPI\u2019s casino-related equipment and security equipment, and any and all other personal property of IPI as further identified in the application for the writ. The clerk shall also provide IPI notice of its rights. Once the U.S. Marshals Service executes the writ of execution, IPI may file, in writing, any exceptions. Such filing is due 14 days after execution of the writ,\u201d said Manglona.<\/p>\n<p>Previously, the court granted Kan Pacific\u2019s motion for summary judgment based upon a breach of contract claim against IPI.<\/p>\n<p>On Dec. 2, 2022, a judgment of $697,801.30, plus post-judgment interest, was entered in favor of Kan Pacific against IPI. Six months later, the court issued a writ of execution over IPI\u2019s motor vehicles and heavy equipment to U.S.A. Fanter Corp., Ltd. a judgment creditor of IPI.
