{"id":47175,"date":"1999-07-01T00:00:00","date_gmt":"1999-07-01T00:00:00","guid":{"rendered":"http:\/\/94cd3c74-1dfb-11e4-aedf-250bc8c9958e"},"modified":"1999-07-01T00:00:00","modified_gmt":"1999-07-01T00:00:00","slug":"94cd3c88-1dfb-11e4-aedf-250bc8c9958e","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/94cd3c88-1dfb-11e4-aedf-250bc8c9958e\/","title":{"rendered":"When is a promissory note not valid?"},"content":{"rendered":"<p>&#8220;A moral obligation is not necessarily a legal one and it alone is not a valid consideration for a promise to pay.&#8221;<\/p>\n<p>Superior Court Associate Judge John Manglona used this jurisprudence in issuing an award judgment favoring a woman who was &#8220;misled&#8221; into paying her deceased mother&#8217;s debts.<\/p>\n<p>The court&#8217;s order was a response to a complaint by Vivian Sablan against Isla Financial Services and Pacific Life Insurance, Ltd.<\/p>\n<p>The case arose from the loan secured in July 1994 by Sablan&#8217;s mother, Paulina A. Sablan, from Isla Financial in the amount of $2,539.95.<\/p>\n<p>Paulina died a few months after securing the loan.<\/p>\n<p>Isla later approached Sablan to collect payment for her mother&#8217;s loan.<\/p>\n<p>Pacific Insurance told Sablan that the company would not cover payment of Paulina&#8217;s loan on grounds that her medical condition was not revealed in the Statement of Good and Health and Instability.<\/p>\n<p>Sablan,  not wanting to leave her mother&#8217;s loan unpaid, signed a promissory note for Isla.<\/p>\n<p>She started sporadic payments of the loan plus interest.<\/p>\n<p>By October 1995, she had paid a total of $805. 90.<\/p>\n<p>But when she resigned from her job, Sablan stopped paying, prompting Isla to file a complaint.<\/p>\n<p>The Micronesian Legal Services Corp., which represented Sablan, said its client had no legal obligation to pay her deceased mother&#8217;s loan, and that she was  &#8220;misled&#8221; into paying what the credit insurance should have paid off.<\/p>\n<p>The Superior Court agreed, and ruled that Sablan is entitled to be paid for damages representing the loan payment she had made.<\/p>\n<p>As for the promissory note, Manglona said it was one of those contracts that bear &#8220;moral obligation&#8221;  which is &#8220;binding  only the conscience.&#8221;<\/p>\n<p>Breach  of this kind of contract, Manglona said, &#8220;is not redressible in the courts.&#8221;<\/p>\n<p>&#8220;A moral obligation will not furnish a consideration for a new contract where there is no legal obligation in the first place.&#8221; the court&#8217;s decision stated.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&#8220;A moral obligation is not necessarily a legal one and it alone is not a valid consideration for a promise to pay.&#8221;<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[],"class_list":["post-47175","post","type-post","status-publish","format-standard","hentry","category-local-news"],"_links":{"self":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/47175","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/comments?post=47175"}],"version-history":[{"count":0,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/47175\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media?parent=47175"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/categories?post=47175"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/tags?post=47175"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
