{"id":47255,"date":"1999-07-09T00:00:00","date_gmt":"1999-07-09T00:00:00","guid":{"rendered":"http:\/\/94d46b52-1dfb-11e4-aedf-250bc8c9958e"},"modified":"1999-07-09T00:00:00","modified_gmt":"1999-07-09T00:00:00","slug":"94d46b65-1dfb-11e4-aedf-250bc8c9958e","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/94d46b65-1dfb-11e4-aedf-250bc8c9958e\/","title":{"rendered":"Court: Zachares, Goldberg\nnot immune from lawsuit"},"content":{"rendered":"<p>Government officials  who perform administrative duties and conduct investigations that have nothing to do with preparations for judicial proceedings are not absolutely immune from lawsuits.<\/p>\n<p>US District Court Judge Alex Munson invoked this jurisprudence in denying labor officials&#8217; motion for dismissal of a lawsuit filed by a nonresident worker.<\/p>\n<p>The case was filed by Ariel Gorromeo against Labor Secretary Mark Zachares and the immigration division&#8217;s legal counsel Asst. Atty. Gen. Robert Goldberg.<\/p>\n<p>Gorromeo, represented by lawyer Anthony Long, alleged that he was arrested and detained twice by labor and immigration agents without any warrant nor proper procedure.<\/p>\n<p>He was first arrested on June 4, 1998 at a construction site where he worked. He said he was not taken before a judge within 48 hours after his arrest.<\/p>\n<p>The arresting agents claimed he was working illegally as he did not have a work permit.<\/p>\n<p>The department later filed a deportation case against him, which the Superior Court dismissed on July 22.<\/p>\n<p>He was released from detention following the court&#8217;s order, only to be arrested again at his house the following day, and again without a warrant.<\/p>\n<p>Zachares and Goldberg, who were sued in their personal capacities, sought the dismissal of the case claiming they enjoyed absolute immunity from suit, and describing Gorromeo&#8217;s allegations as &#8220;vague and ambiguous.&#8221;<\/p>\n<p>In denying  the labor officials&#8217; motion, Munson ruled that the Gorromeo&#8217;s &#8220;factual allegations must be treated as true.&#8221;<\/p>\n<p>&#8220;Plaintiff&#8217;s complaint advanced eight claims for relief alleging violations of [his] 4th Amendment right to be free from unreasonable searches and seizures and an illegal warrantless arrest,&#8221; Munson stated in a written order issued June 29.<\/p>\n<p>Munson also noted that Zachares and Goldberg failed to address the constitutional issues raised by Gorromeo.<\/p>\n<p>&#8220;Absolute immunity protects prosecutors from frivolous lawsuits that could &#8217;cause a deflection of the prosecutor&#8217;s energies from his public duties, and shade his decisions instead of [allowing him to exercise] the independence of judgment required by his public trust,&#8221; Munson wrote.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Government officials  who perform administrative duties and conduct investigations that have nothing to do with preparations for judicial proceedings are not absolutely immune from lawsuits.<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[],"class_list":["post-47255","post","type-post","status-publish","format-standard","hentry","category-local-news"],"_links":{"self":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/47255","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/comments?post=47255"}],"version-history":[{"count":0,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/47255\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media?parent=47255"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/categories?post=47255"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/tags?post=47255"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
