The Department of Labor and Immigration is pushing for the deportation of two aliens who have been overstaying in the CNMI for several years.<\/p>\n
DOLI on Friday asked the Superior Court to reject the motion filed by Alicia Fabricante and Chi Min Yu who are requesting for a stay of the court’s deportation order against them.<\/p>\n
DOLI said Fabricante and Chi “must be deported immediately” as they “failed to present any basis for a stay.”<\/p>\n
Fabricante, a native of the Philippines, has been overstaying in the CNMI for seven years. Her entry permit expired on Sept. 11, 1992.<\/p>\n
Chi, a native of China, had a three\u2014day business permit that expired on Nov. 23, 1993.<\/p>\n
Superior Court Associate Judge Timothy Bellas, in an earlier decision, upheld DOLI’s position that Fabricante and Chi were deportable, but he allowed them to go on voluntary departure, which would allow them to return to the CNMI.<\/p>\n
Fabricante and Chi have appealed their case.<\/p>\n
DOLI, however, maintained “there is absolutely no reason to allow these illegal aliens to remain in he CNMI one minute longer.”<\/p>\n
“Supreme Court has set forth a very high standard for a stay of deportation,” DOLI’s motion stated. “Even if respondents prevail on appeal, respondents must still depart the CNMI.”<\/p>\n
The Fabricante-Chi case is one of the government’s most controversial deportation cases.<\/p>\n
The controversy was brought about by Assistant Atty. General Robert Goldberg’s description of the case as an example of aliens using “children as deportation shields.”<\/p>\n
In an earlier government brief, Goldberg wrote that “an alien’s uterus is not a license to violate our immigration laws,” and that the CNMI should not “become an Asian baby factory.”<\/p>\n
