{"id":6972,"date":"2011-12-01T06:56:05","date_gmt":"2011-12-01T06:56:05","guid":{"rendered":"http:\/\/newspaper.ctsi-logistics.com\/?p=6972"},"modified":"2011-12-01T06:56:05","modified_gmt":"2011-12-01T06:56:05","slug":"fund-incurs-5685-in-attorneys-fees","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/fund-incurs-5685-in-attorneys-fees\/","title":{"rendered":"Fund incurs $5,685 in attorneys&#8217; fees"},"content":{"rendered":"<div>By Ferdie de la Torre<br \/>\nReporter<\/div>\n<p>The NMI Retirement Fund notified the district court yesterday that it incurred $5,685 in attorneys&#8217; fees in responding to Sapuro Rayphand&#8217;s bid to transfer the Fund&#8217;s lawsuit against the Fitial administration from the Superior Court to the federal court.<\/p>\n<p>Fund counsel Braddock J. Huesman asked the U.S. District Court for the NMI to award attorneys&#8217; fees in the amount of $5,685, made payable to the Fund.<\/p>\n<p>Huesman declared that he spent 37.9 hours in responding to Rayphand&#8217;s meritless notice of removal and the accompanying cross-motion to strike. Rayphand is a Commonwealth Retirement Association board member.<\/p>\n<p>Huesman submitted the billings in response to designated Judge Frances M. Tydingco-Gatewood&#8217;s ruling that found Rayphand&#8217;s removal of the Fund&#8217;s lawsuit improper.<\/p>\n<p>In that order, Tydingco-Gatewood remanded the Fund&#8217;s lawsuit to the Superior Court and ordered Rayphand to pay attorney&#8217;s fees and costs to the Fund.<\/p>\n<p>In the eight-page order, Tydingco-Gatewood noted that much of Rayphand&#8217;s argument for intervention is nonsensical and unrelated to the issues at hand.<\/p>\n<p>Attorney Bruce Jorgensen served as counsel for Rayphand.<\/p>\n<p>On Sept. 8, 2011, Rayphand, through Jorgensen, notified the district court that he wants the Fund&#8217;s lawsuit against the CNMI government to be removed from the Superior Court and transferred to the federal court.<\/p>\n<p>Rayphand stated that it has been more than two years now since associate judge Govendo rendered a $230 million judgment in the case yet there has been little, if any, meaningful steps toward enforcement of that judgment.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Ferdie de la Torre Reporter The NMI Retirement Fund notified the district court yesterday&#8230;<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[],"class_list":["post-6972","post","type-post","status-publish","format-standard","hentry","category-local-news"],"_links":{"self":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/6972","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/comments?post=6972"}],"version-history":[{"count":0,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/6972\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media?parent=6972"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/categories?post=6972"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/tags?post=6972"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
