{"id":86099,"date":"2004-12-02T04:43:00","date_gmt":"2004-12-02T04:43:00","guid":{"rendered":"http:\/\/a18a2b4a-1dfb-11e4-aedf-250bc8c9958e"},"modified":"2004-12-02T04:43:00","modified_gmt":"2004-12-02T04:43:00","slug":"a18a2b5b-1dfb-11e4-aedf-250bc8c9958e","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/a18a2b5b-1dfb-11e4-aedf-250bc8c9958e\/","title":{"rendered":"Labor hearing office reverses denial of 5 alien worker permit applications"},"content":{"rendered":"<p>The Department of Labor Hearing Office has reversed the denial of permit applications filed by an employer for five nonresident workers.<\/p>\n<p>In a Nov. 24 administrative order, hearing officer Linn Asper allowed workers Chen Jing, Zhang Yan, Rafael Alvarado, Aurea Baloloy, and Estrella Jumilla to transfer to or continue working for employer Mariano K. Pangelinan.<\/p>\n<p>The Division of Labor earlier denied the permit applications filed for the five workers due to deficiencies. The missing requirements included a certified job vacancy announcement in applications for Chen, Alvarado, and Jumilla; tax documents in the application for Zhang; and cash bond in the application for Baloloy.<\/p>\n<p>But in a Nov. 23 hearing, Pangelinan showed proof that he had complied with the requirements, prompting Asper to reverse the Labor division\u2019s denial of the applications.<\/p>\n<p>However, Asper noted that the lapse of time between Chen and Zhang\u2019s denied applications and the hearing office\u2019s decision means that another renewal application is now due.<\/p>\n<p>Thus, Asper ordered Pangelinan to file new renewal applications for Chen and Zhang on or before Dec. 31.<\/p>\n<p>At the same time, Asper told the Division of Labor to resume processing the applications for Alvarado, Baloloy, and Jumilla.<\/p>\n<p>\u201cIf the employer fails to comply with any of the conditions stated in this order, the department may order the employer to show cause at a hearing as to why sanctions, which may include a bar from employing nonresidents workers in the Commonwealth, should not be imposed on the employer,\u201d Asper said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Department of Labor Hearing Office has reversed the denial of permit applications filed by an employer for five nonresident workers.<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[],"class_list":["post-86099","post","type-post","status-publish","format-standard","hentry","category-local-news"],"_links":{"self":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/86099","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/comments?post=86099"}],"version-history":[{"count":0,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/posts\/86099\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/media?parent=86099"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/categories?post=86099"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.saipantribune.com\/index.php\/wp-json\/wp\/v2\/tags?post=86099"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
