{"id":86208,"date":"2004-12-06T06:06:00","date_gmt":"2004-12-06T06:06:00","guid":{"rendered":"http:\/\/a18b2d0f-1dfb-11e4-aedf-250bc8c9958e"},"modified":"2004-12-06T06:06:00","modified_gmt":"2004-12-06T06:06:00","slug":"a18b2d23-1dfb-11e4-aedf-250bc8c9958e","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/a18b2d23-1dfb-11e4-aedf-250bc8c9958e\/","title":{"rendered":"\u2018MRC settlement bill void\u2019"},"content":{"rendered":"<p>The Marine Revitalization Corp. settlement bill that the Legislature passed Friday is actually void, according to Senate legal counsel Michael Ernest yesterday.<\/p>\n<p>In an interview, Ernest said that House Bill 14-270, which came under lengthy deliberation in both houses, is invalid because the legislative approval did not happen within four months after the 2003 settlement agreement was signed\u2014as was earlier agreed upon. <\/p>\n<p>The bill approves the settlement between the government and MRC and Anthony Pellegrino. It also allocates $800,000 as initial payment to MRC.<\/p>\n<p>In effect, Ernest said the legislative action does not mean actual appropriation of payment to MRC. He said the passage only meant the Legislature is open to approving a settlement.<\/p>\n<p>\u201cIt [settlement bill] is void. The Legislature has shown its willingness to approve a settlement but it has not shown its willingness to appropriate [an award],\u201d Ernest said.<\/p>\n<p>He noted that under the terms and conditions of the agreement, the settlement needed to secure legislative approval within four months. The agreement was signed on Feb. 11, 2003.<\/p>\n<p>\u201cIf it\u2019s not done in four months, it\u2019s done,\u201d he said.<\/p>\n<p>Right now, he said, the parties\u2014government and MRC\u2014have the option to ask the arbitration panel to withhold any decision pending a possible negotiation for a new settlement accord.<\/p>\n<p>Arbitration on the case resumed on Nov. 30 and reportedly ended on Dec. 1. <\/p>\n<p>\u201cI think they\u2019re just waiting for the decision now,\u201d he said.<\/p>\n<p>The Senate passed the bill Friday, authorizing the governor to reprogram or allocate $800,000 from his discretionary funds, \u201cincluding the Lt. Governor\u2019s discretionary funds,\u201d capital improvement funding or Compact Impact funds as initial payment to MRC.<\/p>\n<p>Lt. Gov. Diego T.
