{"id":99428,"date":"2006-04-02T06:56:00","date_gmt":"2006-04-02T06:56:00","guid":{"rendered":"http:\/\/a6c8d334-1dfb-11e4-aedf-250bc8c9958e"},"modified":"2006-04-02T06:56:00","modified_gmt":"2006-04-02T06:56:00","slug":"a6c8d348-1dfb-11e4-aedf-250bc8c9958e","status":"publish","type":"post","link":"https:\/\/www.saipantribune.com\/index.php\/a6c8d348-1dfb-11e4-aedf-250bc8c9958e\/","title":{"rendered":"Construction company sues another firm over airport project"},"content":{"rendered":"<p>A construction company has sued another construction company over their dispute regarding subcontract services related to a project at the Saipan International Airport.<\/p>\n<p>EQ Construction sued ASC Architecture and Structure Corp. that owns ASC Construction, for breach of subcontract agreement.<\/p>\n<p>EQ Construction, through counsel Danilo Aguilar, stated in the complaint that as of Dec. 4, 2003, ASC Construction has an outstanding balance on the subcontract agreement in the amount of $11,367.<\/p>\n<p>The plaintiff asked the Superior Court to order ASC Construction to pay the outstanding balance, attorney\u2019s fee, and court costs.<\/p>\n<p>Aguilar said that on Sept. 20, 2001, EQ and ASC entered into an agreement.<\/p>\n<p>Under the agreement, EQ will provide construction services to defendant in connection with the implementation of defendant\u2019s project known as the \u201cSaipan International Airport roof fascia and airport signage.\u201d<\/p>\n<p>The agreement provided that in return, defendant would pay EQ a lump sum of$60,000 services, 10 percent of which will be initially paid for mobilization 80 percent during the construction period, and the final 10 percent after completion of the project.<\/p>\n<p>Aguilar said that from the period Oct. 22, 2001, through Oct. 28, 2003, his client provided and has fully performed all services required by the defendant.<\/p>\n<p>For the same period of time, defendant has made some payments, he said.<\/p>\n<p>On Dec. 4, 2003, plaintiff sent a final billing for the balance due in the amount of $11,367.36.<\/p>\n<p>\u201cDespite repeated follow-up by phone, no payment was made by defendant,\u201d the lawyer said.
