Firm sues over building construction dispute

A construction firm has sued a corporation and its president for allegedly refusing to pay the balance of payment for the construction of a commercial building in Gualo Rai.

Bee Industrial Corp., through counsel David G. Banes, sued the Future World Corp. and its president Tae Wu Ung for breach of contract and unjust enrichment.

Bee Industrial asked the Superior Court to order the defendants to pay $23,225 in general damages, attorney’s fees, and court costs.

Banes stated in the complaint that on Jan. 20, 2005, Bee Industrial, through its manager, Eduardo B. Mendoza, entered into an agreement with defendants.

Banes said under the agreement, Bee Industrial would render construction services consisting of labor and materials to defendants such as foundation of first floor of a proposed two-story commercial building on a lot along Middle Road in Gualo Rai.

Ung has a 55-year tenancy on the lot and so is the owner of the building, the lawyer said.

Defendants agreed to pay plaintiff $216,000 for the construction of the first floor foundation of the building, he said.

Banes said his client provided construction services to defendants and completed the construction of the first floor foundation of the building.

“As a result of the construction services provided by plaintiff, defendants incurred an unpaid balance in the total amount of $23,225,” he said.

Despite repeated demands for payment, Banes said, defendants have failed and refused to pay for construction services rendered by Bee Industrial.
