Family of 4 sues driver for car mishap

A family of four who was injured in a vehicular collision along Beach Road in May last year has sued the driver of the other car that allegedly swerved into oncoming traffic.

Jose V. Belnas, his wife Felisa D. Belnas, and their two children, sued Gu Hee Park for negligence. They are seeking unspecified damages, interest, and court costs.

According to the complaint, the Belnas family was aboard their 1988 Isuzu Trooper that was traveling along the outer lane of Beach Road on May 16, 2010 at 10:45am when a 2008 Toyota Scion XD being driven by Park, which was traveling north, suddenly swerved directly into Belnas’ lane.

Jose Belnas, who was driving, stepped on the brakes but still hit Park’s vehicle on the passenger side.

The complaint stated that the impact was so intense that it hurt all members of the Belnas family and they had to be taken to the Commonwealth Health Center. Belnas’ vehicle was also severely damaged.

A traffic crash report indicated that the Department of Public Safety had investigated the accident and had concluded that Park was at fault.

“As a proximate result of the deliberate disregard of and reckless indifference to the safety of others and negligence of Ms. Park, and her failure to comply with the CNMI traffic rules, including improper lane change, driving off the road, and failing to keep a proper lookout, plaintiffs suffered physical injuries requiring the services of physicians, nurses, and other medical and rehabilitative personnel,” the complaint said.
