Man who threw rocks at a party gets 1 year in prison

Superior Court Associate Judge Kenneth L. Govendo has imposed a one-year prison sentence on a man who, while drunk, threw rocks at a birthday party in Garapan where there were some children.
At a hearing last week, Marco W. Selepeo Fitial, 33, pleaded guilty to assault with a dangerous weapon as part of a plea deal.
Govendo sentenced Fitial to five years in prison, all suspended except for one year, to be served without the possibility of parole, early release, or weekend release.
Fitial was given credit for 98 days of time served. He is expected to be released on Sept. 16, 2014.
After serving his sentence, Fitial will be placed on five years’ probation.
Fitial was required to pay $1,023.43 in restitution to the owner of a 2007 Toyota Yaris that was damaged in the attack. He was also ordered to pay a $100 fine, $100 court assessment, and $500 probation fee.
The Office of the Attorney General had charged Fitial with three counts of assault with a dangerous weapon, one count of criminal mischief, four counts of disturbing the peace, and one count of criminal contempt.
Fitial and his counsel, the Office of the Public Defender, signed a plea deal with assistant attorney general Chemere K. McField. For pleading guilty to one count of assault with a dangerous weapon, the government agreed to dismiss the remaining charges.
According to the information filed by Chief Prosecutor Shelli Neal, Fitial approached the Casa De Felipe Apartment complex on July 25, 2013 on Saipan, and started an altercation with residents who were having a get-together. He then picked up five large rocks and threw them at the residents, causing damage to a vehicle.
Police said that Fitial, who appeared drunk, had been invited to eat but after eating, he threw his trash on the table, scattering the food.
