Man accused of smashing truck’s windshield gets 6 months in jail

A man accused of smashing the front windshield of his father’s Toyota T-100 pickup truck with a hollow block and damaged other items in their house, pleaded guilty on Wednesday and was slapped with a six-month imprisonment.

Franklin Anthony Arriola Agulto, 23, signed a plea deal with the government and pleaded guilty to disturbing the peace (domestic violence).

Superior Court Associate Judge Joseph N. Camacho accepted Agulto’s guilty plea and the plea deal.

Camacho ordered the defendant to serve the six months imprisonment day for day without the possibility of parole, probation or work release.

Agulto was given credit for 85 days of time served.

After the hearing, Camacho ordered the court marshal to take the defendant back into the custody to start serving his sentence immediately.

The Office of the Attorney General amended the information/charges thrice, leaving only the charge of disturbing the peace, which carries a maximum sentence of six months.

On May 4, 2016, the OAG filed the information charging Agulto with criminal mischief, disturbing the peace, and illegal possession of a controlled substance.

Later on that same day, OAG filed an amended information containing one count of criminal mischief (domestic violence), disturbing the peace (domestic violence), and illegal possession of a controlled substance.

On May 17, 2016, OAG filed a second amended information containing criminal mischief (domestic violence), disturbing the peace (domestic violence), and illegal possession of a controlled substance.

On Wednesday, OAG filed an unopposed motion for leave to amend information, moving the court to file an amended information in this matter in order to dismiss two of the offenses charged in the previous case. The court granted the unopposed motion that day.

The third amended information contained one count of disturbing the peace (domestic violence).

Camacho noted that Agulto has a pending criminal case for disturbing the peace.

Camacho said it’s the OAG that decides what charges to file and the court can only hear the case and charge that the OAG files.

According to the factual basis of the plea deal, on April 20, 2016 on Saipan, Agulto smashed the cabinets in his mother’s house, causing her to call the police.

Police said Agulto damaged the front windshield of his father’s truck and other items in the house, after his mother refused to allow him to use the vehicle.

When police officers responded to the house, they also found near the residence some marijuana plants in flower plots that Agulto allegedly planted the marijuana.

Agulto also allegedly punched one glass cabinet, smashing it. As a result, he sustained a cut on the right hand. He also threw and smashed a cooking pot at another glass cabinet door.

The mother and sister told police that the marijuana plants found near the house belong to Agulto, who is a marijuana user.
